TDSAT to decide if the TRAI order on international bandwidth pricing can be challenged

According to news reports, the TDSAT will decide if the TRAI order on international bandwidth pricing can be challenged. TRAI maintains that price fixation lies in its exclusive domain and is a legislative function of a statutory body, and hence cannot be challenged.
However, VSNL is of the view that orders relating to international bandwidth are quasi-judicial and can be challenged. In addition to questioning the need to regulate international bandwidth, the service provider has told the TDSAT that TRAI had not shared relevant data with it prior to the tariff revision. The regulator had earlier imposed ceilings on international bandwidth charges.
